Qatar Labour Law: Most Common SME Violations (and How to Avoid Fines)
With Qatar’s increased cooperation with the ILO and stricter enforcement of labour reforms, SMEs face growing scrutiny of their employment practices. Here are the ten most common violations we see—and how to avoid costly fines.
Top 10 SME Labour Law Violations
1. Missing or Non-Compliant Employment Contracts
The Problem: Many SMEs operate with verbal agreements or contracts that don’t meet legal requirements.
The Fix: Ensure every employee has a written contract in Arabic (with English translation if needed) that includes all mandatory terms: job title, salary, working hours, leave entitlements, and contract duration.
2. Overtime Calculation Errors
The Problem: Incorrect calculation of overtime pay, especially for working hours beyond 48 per week.
The Fix: Implement proper time tracking and calculate overtime at 125% of basic salary (150% for night work and holidays).
3. Annual Leave Violations
The Problem: Not providing the mandatory 3 weeks (21 days) of annual leave, or not allowing employees to take it.
The Fix: Track leave accruals carefully and ensure employees take their entitled leave. After 5 years of service, this increases to 4 weeks.
4. WPS Non-Compliance
The Problem: Late salary payments or payments outside the Wage Protection System.
The Fix: Process all salaries through WPS by the 7th of each month. Set up automated payroll to ensure consistency.
5. Improper Termination Procedures
The Problem: Terminating employees without proper notice, documentation, or settlement calculations.
The Fix: Follow the correct notice periods (1-2 months depending on tenure), document reasons for termination, and calculate all final settlements accurately.
6. Accommodation Standards
The Problem: Providing worker accommodation that doesn’t meet minimum standards.
The Fix: Ensure accommodation meets space requirements, has proper ventilation, sanitation, and complies with fire safety regulations.
7. Working Hours Violations
The Problem: Exceeding maximum working hours without proper breaks or rest days.
The Fix: Cap regular hours at 8 per day / 48 per week. Provide at least one rest day per week and mandatory breaks during shifts.
8. Health and Safety Failures
The Problem: Inadequate workplace safety measures or failure to report accidents.
The Fix: Implement safety protocols, provide PPE where required, conduct regular training, and report all workplace incidents.
9. Document Retention Issues
The Problem: Holding employee passports or other personal documents.
The Fix: Never retain employee documents. Provide secure storage options for employees who request safekeeping.
10. Probation Period Abuse
The Problem: Using probation periods incorrectly or extending them beyond legal limits.
The Fix: Probation cannot exceed 6 months. Document performance issues during probation if termination becomes necessary.
